Comment : The constitutional reform - a call of the times
 
The epoch of new Revival has introduced the fundamental changes to all spheres of the life of the Turkmen state, its institutional and economic systems, has created the new conditions for development of the democratic institutions and an individual as the highest value of the society. To ensure effectiveness and irreversibility of reforms much work has been done on provision of the legal guarantees for the reforms, improvement of the national legislation in compliance with the modern realities and the norms of the international law. Further implementation of the legal reform as well as the progressive transformations hinges on the objective necessity of revising the Constitution as the foundation of the state structure and legislative system. That was clearly and definitely stated by the initiator of the Turkmen reforms Gurbanguly Berdimuhamedov at the first meeting of the Constitutional Commission.

The Constitution is referred to as the Fundamental Law - it has the supreme legal effect, establishes its political and economic system, defines the structure, procedures, powers and duties of the executive, legislature and the judiciary as well as the fundamental rights, freedoms and duties of citizens. The Fundamental Law carries the profound constructive potential reflecting the priorities of the society and aims to embody them.

However, with time, under the influence of life and the changes in the state some provisions of the Constitution become obsolete hampering development of the society, its consistent advance. Therefore, various forms of the constitutional reform varying from adopting the constitutional amendments to revising the main provisions of the constitution are practiced in the world. The current Constitution of Turkmenistan went through several reforms aimed at fulfilling the important tasks of social, political and economic development at the particular stages of national development

The epoch of new Revival with its new objectives and priorities demands that national development be synchronized with the dynamics of the global process. Speaking at the enlarged sitting of the Cabinet of Ministers President Gurbanguly Berdimuhamedov stated that the deeper political and legal thinking and on this basis implementation of the particular measures to improve the government of the state, especially the supreme government bodies of Turkmenistan were of paramount importance for elaborating the new approaches to the important political and social and economic tasks. The clearer definition of the legal status of these bodies will help to improve the system of governance and the mechanism of adopting the laws, which are to clear the way for the progressive reforms.

Drafting the new version of the Constitution is an important and crucial aspect of the general strategy of the country’s modernization. Therefore, the thorough preliminary work was carried out. In accordance with the Law the Commission on Improvement of the Constitution of Turkmenistan was established, President of Turkmenistan, Chairman of the Halk Maslakhaty Gurbanguly Berdimuhamedov issued the Resolution approving the membership of the Commission and the plan of work.

The national ministries and research departments responsible for organizing the special workgroups to analyze the relevant laws and to elaborate the proposals on the amendments and additions to the Constitution are involved in drafting the new version of the Fundamental Law. The proposals to amend the constitutional provisions prepared by the khykimliks, self-government bodies, various sectors of national economy as well as public opinion will be taken into account. The proposals to amend the constitutional provisions will be submitted to the Mejlis of Turkmenistan and generalized by the expert group of legislators and scientists. Chairman of the Constitutional Commission Gurbanguly Berdimuhamedov specified the relationships between the Parliament and the Commission at all stages of drafting the Fundamental Law until the special session of Halk Maslakhaty is held to consider the results of this important work. The mass media is to play the special role in this process. The representatives of the Turkmen mass media will participate in the meetings of the Constitutional Commission each month and inform the people of the progress of this important work affecting the interests of every citizen of Turkmenistan.

The new Constitution of Turkmenistan will be based on the best achievements of modern theory and practice of the government of the state and law. It will reflect the provisions of the international documents signed and ratified by Turkmenistan, the progressive tendencies of development of our society in the course of the common civilized tendencies and humanistic values. The Constitution is to define the strategic task of building the democratic, jural state with market economy, the high living standards and give scope to the effective fulfillment of this task. The principle “a state for the people” will be embodied in the constitutional norms guaranteeing the supremacy of law and exercise of the rights and freedoms of an individual in the civilized society. Reaffirming its adherence to the goals and principles of the Universal Declaration of Human Rights Turkmenistan regards an individual and his interests as of paramount importance that will be the “supporting structure” of the Fundamental Law. Through recognizing the priority of the universally recognised norms of international law our country will enter the global political and economic space, integrate with the international community.
