In policy speech at the meeting with the deputies of Parliament of Turkmenistan on January 15, 2015, President Gurbanguly Berdimuhamedov emphasized that in the near years, Turkmenistan plans to realize a large work on development of export-oriented productions. An important role in export of products is attached to the Chamber of Commerce and Industry of Turkmenistan (CCIT). It was noted the necessity of reconsideration of laws connected with its activity.
Proceeding from these purposes, the national parliament started the development of relevant law in draft. The workgroup included the representatives of core ministries and departments, including the representatives of CCIT. It was studied the international experience, analyzed the norms of current legislation, their correspondence with modern economic realities and tendencies. On this basis, it was determined the special-purpose provisions of new law.
Law of Turkmenistan “On Chamber of Commerce and Industry of Turkmenistan” was passed at the regular, seventh session of the Parliament of Turkmenistan of the fifth convocation. It determines the legal and economic foundations of the Chamber of Commerce and Industry of the country, organizational and legal forms of its activity and measures of the state support.
Being legal entity, the Chamber of Commerce and Industry of Turkmenistan is non-commercial social organization, merging on a voluntary basis the enterprises, institutions regardless of patterns of ownership, and the entrepreneurs, realizing their activity without formation of legal entity urged to support and protect their interests. The purpose of CCIT is the assistance to further strengthening of national economy, its deeper integration into world economic system, improvement of modern industrial, financial and trade infrastructure, creation of favorable conditions for entrepreneurial activity, development of state and private partnership, trade-economic, investment and scientific-technical cooperation.
The law assigns the Chamber of Commerce and Industry of Turkmenistan the important and responsible tasks, including on assistance to the entrepreneurial activity taking into account the economic interests of separate sectors, regions and enterprises, increase of export volumes of goods and services.
It is noteworthy that in the Law, it was allocated the provisions on International commercial arbitration, which under agreement of the parties, considers the disputes from contractual and other civil and legal relations, arising while realization of foreign trade and other kinds of international economic ties.
Here, it is worth to pay attention to the fact that on August 16, 2014, it was passed a Law of Turkmenistan “On international commercial arbitration”, which will come into effect on January 1, 2016. It outlines major provisions on creation and activity of this institutional body. Adoption of the Law “On Chamber of Commerce and Industry of Turkmenistan” was another important stage in realization of the goals and tasks set before, as well as confirmation of complex approach to their solution. At that, it was prepared relevant legislative basis for the activity of International commercial arbitration in Turkmenistan. But, this work has not been completed yet. It is necessary to take further steps on detail regulation of the activity of International commercial arbitration. The specialists of Chamber of Commerce and Industry of Turkmenistan will engage in this important and vital issue.
For attainment of goals set by the head of state before national parliament, the deputies will continue the work on further improvement of legislation, regulating the relations in the field of ownership and aimed at support of commodity producers and sphere on rendering the services.
