The Law on Cinematography has been adopted in our country for the first time. According to the Law, the national cinematography is an important and integral part of the national culture. This is due to the value and the role cinema plays in the life of society and each person. Today, there are no doubts that based on the level of impact on the formation of the system of values and standards of conduct cinema is equal to education and development.
Moreover, film chronicles stand as a historical archive. Ultimately, cinematography is a complex process that covers different areas: creative, industrial, scientific, technical, educational, informational ones. All this as a whole requires a unified and integrated system of legal regulation of relations in the field of cinematography. The main goal of the Law is to create a regulatory legal framework of the national cinematography to meet modern trends of its development.
Cinematography as a part of the Turkmen people’s national culture focuses on the affirmation of the ideas of humanism, universal, national, cultural and spiritual values. Cinematography is to promote the development of national consciousness, patriotic feelings, aesthetic and environmental education.
Cinematography is a type of art work therefore, the Law guarantees artistic freedom, protection of copyright and related rights, that meet the requirements of the relevant constitutional provisions. Freedom of creativity in the field of cinematography is provided by the freedom to choose directions, methods and techniques of creative activity, the forms and methods of implementation of creative ideas, the definition of themes and genres of movies.
To offer a powerful impetus to the development of the national cinematography and distribution of movies, the Law introduced the concept of ‘a national film’. The film is a national one if its script and subject reflect the most important trends of the historical, socio-economic and cultural development of Turkmenistan, character, traditions and national features of the Turkmen people. Moreover, the majority of the filmmakers must be citizens of Turkmenistan. A film made in accordance with international agreements of Turkmenistan jointly with foreign producers is also considered as the national film.
The recognition of cinematography as a field of culture, and a national film as a cultural heritage requires the state support to this critical area. The Law clearly stipulates that the government support is the main condition for the development of the film industry in the country, its artistic, production, technical, educational, scientific and information base. The state takes the responsibility for the preservation and development of cinematography and creation of all necessary conditions so that the local population has access to the works of cinematography.
The priorities of the state policy in the field of cinematography include the production of national films and their popularization, production of films for children and youth, popularization of the best samples of world cinema, which are of particular social and cultural significance.
The government control over the field of cinematography is carried out by the Cabinet of Ministers and relevant authorized state bodies and local executive bodies.
As for the support of cinematography, it should be noted that when drawing up the state budget, the Government allocates funds to finance the public organizations of cinematography, including production of national films and ensuring access for all segments of the population to the works of cinematography.
The Law presents the procedures for public performance and distribution of films, which can be made only if the relevant distribution certificate is issued by the authorized body. The information about the films, which received the distribution certificate for performance and distribution are entered into the State Register. The state regulates the requirements to cinemas and theaters.
The Law is to promote the qualitative development of cinematography in Turkmenistan and open up ample opportunities to implement the rights and interests of all subjects of cinematography.
