President Gurbanguly Berdimuhamedov with this Decree declared:
1. To cease work of the State Agency on Management and Use of Hydrocarbon Resources under the President of Turkmenistan.
2. The functions of the ceased work of the State Agency on Management and Use of Hydrocarbon Resources under the President of Turkmenistan:
on the issue of licenses for oil and gas works in accordance with the law and the terms of the contracts mentioned in the second paragraph of section 3 of this Decree, and the extension of terms of the licenses;
to exercise control over the oil and gas projects, referred to the second paragraph of Part 3 of this Decree;
to carry out relevant work on international oil and gas projects entrusted to the State Concern "Turkmengas";
the functions of issuing licenses to carry out petroleum operations in accordance with the law of Turkmenistan and the terms of contracts and agreements referred to in the third paragraph of Part 3 of this Decree, and the extension of terms of these licenses;
to negotiate the implementation of the petroleum operations on the licensed seeshore blocks located in the Turkmen sector of the Caspian Sea, the conclusion of contracts on the basis of negotiation and licensing;
to exercise control over implementation of the oil and gas projects, referred to in the third paragraph of Part 3 of this Decree to assign it to the State Concern "Turkmennebit".
3. To determine that the State Concern "Turkmengas" and "Turkmennebit" respectively are the legal successors of the ceased work of the State Agency on Management and Use of Hydrocarbon Resources under the President of Turkmenistan, including:
The State Concern "Turkmengas" is the legal successor in accordance with the Production Sharing Agreement, signed with China National Petroleum Corporation «International Ltd» in the contract area «Bagtyýarlyk», the Production Sharing Agreement in the contract area «Toplum-1", signed with the company «Petronas Çarigali (Türkmenistan ) Sdn. Bhd »(Malaysia);
The State Concern "Turkmennebit" is the legal successor in accordance with the Production Sharing Agreement, signed with the company «Dragon Oil (Türkmenistan) Ltd» (United Arab Emirates) in the contract area «Çeleken», the Production Sharing Agreement signed with the company «Eni Turkmenistan Limited» (Italian Republic) in the contract area «Nebitdag», the Production Sharing Agreement signed with a company «Mitro International Limited» (Republic of Austria) in the contract area «Hazar», the Production Sharing Agreement signed with the company «Berid Hill Serdar Limited» (United Kingdom) in the contract area «Toplum-III», the Production Sharing Agreement signed with a company «ARETI GRUP LIMITED» (Republic of Cyprus) in the contract area «Toplum-21 ", the Production Sharing Agreement signed with the company« RWE Dea AG »(Federal Republic of Germany) in the contract area «Toplum-23. "
4. Transfer funds from foreign currency account of the ceased work of the State Agency on Management and Use of Hydrocarbon Resources under the President of Turkmenistan of the State Bank for Foreign Economic Affairs of Turkmenistan to the special account of the State Concern "Turkmengas" in the Central Bank of Turkmenistan and to use these funds in accordance with the law of Turkmenistan.
5. The State Concern "Turkmengas" and "Turkmennebit" by agreement with Cabinet of Ministers of Turkmenistan to ensure rational use of the properties of the ceased work of the State Agency on Management and Use of Hydrocarbon Resources under the President of Turkmenistan.
6. The State Concern "Turkmengas" and "Turkmenoil" together with the Ministry of Justice of Turkmenistan within one month period to prepare and submit for consideration to the Cabinet of Ministers of Turkmenistan proposals to amend the law of Turkmenistan its changes and additions arising from this Decree.
