As is well known in our country, great attention is paid to improving labor relations and legislation in this field. Not so long ago, in November last year, with the aim of improving work efficiency in workers and other groups, Bringing labour legislation into line with modern requirements by specialists and legal experts at the legislative level, proposals were made and corresponding changes to the Labour Code of Turkmenistan. In particular, article No. 8 invalidates paragraph No. 2, which stated that "Any work (service) required of a person under threat of any punishment, for which this person has not voluntarily offered his services, is considered forced or compulsory labor. Compulsory or compulsory labour also includes the employer’s requirement for an employee to perform work duties in the absence of collective or individual protection systems, or in the case of when the performance of the required work may endanger the life or health of the employee, so too violation of the established payment deadlines or not full payment, an increase in working hours without corresponding remuneration», and also paragraph 7 of the same article - «small public works, that is to say, work performed for the direct benefit of the working group by members of this collective, which can therefore be considered as ordinary civic duties of the members of the team». The legislators also considered the question of revision and removal in article 8 of the Code, declaring the prohibition of forced or compulsory labour paragraph 2 that «any work (service) is part of ordinary civic duties» and paragraph 7 - «small public works, that is, work performed for the direct benefit of the labour collective by members of this collective and which can therefore be considered as ordinary civic duties of the members of the collective».
In order to change the control over the participation of trade union organizations and associations in the implementation of labor legislation in their activities, some changes have also been made. In particular, amendments were made to paragraph 23 of article No. 8, which previously stated that "in order to monitor compliance with the labor legislation of Turkmenistan, trade unions and their associations establish technical and legal labor inspections of trade unions, which are authorized by the provisions approved by the National Center for Trade Unions of Turkmenistan." Now the National Trade Union Center has the right to independently consider individual issues by creating special technical and legal services. These amendments were made in connection with the established practice and international experience in the activities of trade union organizations and associations.
It should be noted that the regular improvement of the legislative framework in such areas as labor relations and labor legislation is under the constant supervision of President of Turkmenistan Serdar Berdimuhamedov and the National Leader of the Turkmen people, Hero Arkadag. In such a sensitive and important area of legal relations as labor norms and rules, there should be no place for different interpretations and interpretations.
